Please read these Terms of Use ("Terms") carefully before using the Crimson Fuji website at crimsonfujiion.net (the "Platform"), operated by Crimson Fuji LLC ("Crimson Fuji," "we," "our," "us"). By accessing or using the Platform you agree to be bound by these Terms.
1. Entertainment Only — No Gambling
Crimson Fuji is a free-to-play social gaming platform for entertainment purposes only. No real money, cryptocurrency, prizes, goods, services, or items of monetary value of any kind can be won or lost on this Platform. Nothing on this Platform constitutes gambling, a lottery, a sweepstakes, or any other form of game of chance for consideration. Crimson Fuji is not a gambling operator and is not licensed as one.
2. Age Requirement
You must be at least 18 years old to access or use this Platform. By accessing the Platform you represent and warrant that you are at least 18 years of age. If you are under 18, you must leave the Platform immediately. We do not knowingly allow use of the Platform by persons under 18.
3. Free Platform — No Purchases Required
All games and content on Crimson Fuji are free to access and play. No payment, subscription, or purchase is required to use any feature of the Platform. We reserve the right to introduce optional supporter features in the future, but access to our existing games will remain free of charge.
4. Intellectual Property
All content on the Platform, including but not limited to game designs, artwork, code, graphics, text, and the Crimson Fuji and Crimson Fuji Studio names and logos, are the exclusive intellectual property of Crimson Fuji LLC or its licensors. You may not copy, reproduce, distribute, modify, create derivative works of, or exploit any part of our content without prior written permission.
5. User Conduct
When using the Platform you agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the Platform or its related systems.
- Transmit any malicious code, viruses, or disruptive content.
- Misrepresent your identity or age.
- Use automated means (bots, scrapers) to access the Platform without our written consent.
- Attempt to reverse engineer, decompile, or extract the source code of our games.
6. Newsletter and Push Notifications
You may optionally subscribe to receive email newsletters and push notifications from Crimson Fuji. By subscribing you consent to receive such communications. You may withdraw consent and unsubscribe at any time by contacting us at [email protected] or by using unsubscribe links provided in communications. Withdrawal of consent does not affect the lawfulness of prior processing.
7. Achievements and Recognition Badges
Our Platform includes a decorative achievement system ("Achievement Badges"). These badges are purely decorative and carry no monetary value. They cannot be exchanged for money, prizes, goods, services, or any other benefit. They are entertainment features only.
8. Disclaimers
The Platform and all content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We are not responsible for any loss of data resulting from your use of the Platform.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Crimson Fuji LLC, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Platform shall not exceed USD $100.
10. Indemnification
You agree to indemnify and hold harmless Crimson Fuji LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Platform.
11. Third-Party Links and Services
The Platform may contain links to third-party websites or use third-party services (such as OneSignal for push notifications). We are not responsible for the content, policies, or practices of those third parties. Links do not imply endorsement.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Modifications
We may update these Terms from time to time. We will post updated Terms on this page with a revised effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. If you disagree with any change, your remedy is to stop using the Platform.
14. Governing Law
These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved in the courts of Hennepin County, Minnesota.
